Today, matter is listed for reply and arguments on
application under Order 8 Rule 1 CPC.
During the course of hearing, Ld. Counsel for plaintiff
fairly submits that he does not have any objection to the aforesaid
application and the same may be allowed. Heard.
In view of the submissions and the no objections given by
the Ld. Counsel for plaintiff, the aforesaid application under Order 8 rule
1 CPC seeking condonation of delay in filing WS, is hereby disposed of
as allowed. Delay in filing WS is hereby condoned. WS is taken on
record.
Replication, if any, be filed within four weeks with an
advance copy to the opposite side.
Parties are also directed to file the affidavit of
admission/denial and proposed issues within same period with an
advance copy to each other.
Matter is adjourned.
Matter be listed for replication, admission/denial of
documents and framing of issues on 03.08.2026. NDOH is given as per
convenience of the Ld. Counsels for the parties.
