Today, an application u/o VI Rule 17 CPC alongwith
amended plaint has been filed on behalf of the plaintiff. Heard.
Perused. By way of present application the plaintiff only seeks to
amend the valuation clause of the plaint. The same shall not
change the nature of the suit and as the summons have not been
issued, no prejudice would be caused to the defendant.
Accordingly, application in hand stands allowed and the amended
plaint is taken on record.
On perusal of amended plaint it is observed that one
of the reliefs has been valued at Rs. 20 Lakhs for the purposes of
jurisdiction and thus the present suit is beyond the pecuniary
jurisdiction of this Court. Accordingly, the plaint is returned as
per rules.
File be consigned to record room after due
compliance.
