are taken on record.
Ld. Counsel for the Defendant No. 2 and 3 submits that defendant no.2
and 3 do not have any concern with the suit property and they do not intend to
dispossess the plaintiff or raise any construction at the suit property.
Ld. Counsel for the Defendant No.2 submits that the suit property had
been sold to some other person, details of which will be filed on or before the NDOH.
Submissions heard. On query from Ld. Counsel for the Plaintiff, he
submits that the suit property is comprising of ground floor only. He is directed to
file site plan on NDOH and shall supply copy of the same in advance to opposite
party.
Ld. Counsel for the Defendant 1 and 4 submits that defendant no.1 and
4 will not dispossess the plaintiff from suit property without due process of law and

will not enter into the suit property forcibly during pendency of the case. Further,
defendant no.1 and 4 will not do any unauthorized construction at the suit property
till NDOH.
Defendant no.1, 2, 3 and 4 shall remain bound by the undertaking given
by their respective counsels. Application under Order 39 Rule 1 and 2 CPC is
disposed off accordingly.
Ld. Counsel for the Plaintiff has filed certain documents. Copy supplied.
Put up for completion of pleadings/filing affidavit regarding admission/
denial of the documents/ framing of issues for 14.03.2024.
