No reply has been filed to the application under O 8
R 10 CPC filed by the plaintiff. Right in that regard is closed.
Arguments advanced.
It is seen that the MCD in its WS has stated that
upon inspection having been undertaken, suit property was found
to be as per standard sanction building plan permissible by
DUSIB and no fresh construction at the site was apparent. Ld.
Counsel for the defendants no. 1 to 4 also states that he is ready
to give a statement with regards taking steps, if at all, required as
per law only and shall not dispossess the plaintiff by force. The
same is put to the Ld. Counsel for the plaintiff, who is not
agreeable to the same. The matter requires deliberation. As such
therefore, both the sides to make submissions on NDOH.
