defendants no. 1 & 4 through VC.
Mr. Dhruv Nagpal, Ld. Proxy Counsel for the
defendant no. 6 / MCD.
It is seen that defendant no. 3 was served and
appearance was entered into on its behalf as far back as on
08.11.2023. No WS filed till date. Statutory period of filing WS
has already expired. Therefore, defence of defendant no. 3 is
struck off. Hence, he is proceeded ex-parte.
Further, Ld. Counsel for the defendants no. 1 & 4
points out that an application under O 11 R 1 CPC has not been
replied to till date, based upon which WS is required to be filed.
Ld. Counsel for the plaintiff states that a copy of such application
has been received only today. Time sought for filing reply. Heard.
Allowed. Final opportunity granted. Let the needful be done by
NDOH with an advance copy to the opposing side at least a week
prior thereto.
