On perusal of the case file, it is observed that the matter is at
the stage of making of payment. JD however, seeks more time and states
that he can only make payment in installments. The DH present is not
agreeable and states that the money was lent long time ago and even after
the passing of the decree in question, more than one year has passed.
In view of the above, the court is of the view that no further
time is required to be granted to the JD as payment has still not been made.
It is also seen that the DH has correctly pointed out that more than a year
has already passed since the date of passing of the judgment/decree sought
to be executed now. Accordingly, contentions of the JD seeking more time
are declined.
Issue warrants of attachment against the movable properties
of JD on filing of PF for the next date of hearing. SHO of concerned PS is
directed to provide necessary police aid for execution of warrant of
attachment. Copy of letter No. F2(23)/Judl/NW/RC/18 12274 dt. 08.10.2018
shall be sent alongwith process.
DH shall file an affidavit that there is no stay on the present
execution proceedings. Affidavit be filed at least two days prior to the
issuance of warrants of attachment.
DH shall appear before Ld. ACJ for appointment of bailiff on
10.07.2025 and for report on 10.10.2025.
