On perusal of the case file, it is observed that some
proceedings are pending consideration before the Hon'ble High
Court of Delhi as well pertaining to the facts of the case.
Nevertheless, it is pointed out that vide order dated 19.09.2023
the then Ld. Predecessor had noted down the crux of the
grievance of the plaintiff and the MCD had undertaken that no
demolition action will be undertaken until directions are passed
by the Hon'ble High Court of Delhi. WS was directed to be filed.
However, since then the said order has not been complied with.
Even the defendant no. 2 has also likewise not being
appearing/filing reply.
In view of the above, let court notice be issued to
both defendants no. 1 and 2 for filing updated status report/WS
with an advance copy to the plaintiff, returnable for NDOH.
