File taken up on application for early hearing in the matter.
Present : Sh. Ram Singh, ld. Counsel for plaintiff.
The application for early hearing is allowed in view
of the submissions made. An application u/O 6 Rule 17 CPC has
been filed on behalf of the plaintiff wherein the plaintiff wants to
amend the plaint to cure technical defects. The matter is at a
nascent stage and no notice has been issued to the opposite
party. The plaintiff wants to correct the valuation in the plaint.
Deficient court fees in accordance with the valuation has been
filed alongwith amended plaint. In view u/o 6 Rule 17 CPC
stands allowed. Amended plaint is taken on record.
Issue fresh summons for settlement of issues for
service upon the defendant by ordinary process as well as
through post/speed post/courier/email/whatsapp on filing of
PF(within 15 days), returnable for date fixed i.e. 28.05.2025.
Process Server is directed to give report of three
mandatory visits and in case of non availability/refusal summon
be served by way of affixation.
Further, plaintiff to submit the internet generated
tracking report of proof of delivery of summons sent through
post alongwith the certificate of Section 65B of the Indian
Evidence Act for the next date.
