WS already filed on behalf of the defendant no. 1
previously. Defendant no. 2 also filed its WS on LDOH. Taken on
record. Copy be supplied to the plaintiff during the course of the day.
It is seen that in the application under O 39 R 1 and 2
CPC, plaintiff has sought restraining the defendants from creating
third party interest in the suit property / or till returning the entire
articles etc. of the plaintiff lying in the suit property.
Ld. Counsels for both the defendants state that there is
no intention on part of the defendants to create third party interest in
the suit property.
The aspect of returning articles etc. of the plaintiff
cannot be gone through at this stage as the same is premature.
In view of the above, defendants are hereby restrained
from creating third party interest in the suit property during the
pendency of the Court proceedings.
Application under O 39 R 1 and 2 CPC stands allowed
in the above-mentioned terms.
Put up for completion of pleadings on 06.10.2025.
