Counsel for the plaintiff submits that he does not want to
file replication.
None for defendant no. 1 has appeared despite service and
no WS has been filed on behalf of defendant no.1. Accordingly, matter is
proceeded exparte against defendant no. 1.
Pleadings are complete. From the pleadings of the parties,
following issues are framed : -
1. Whether the plaintiff is entitled to decree of mandatory
injunction directing the defendants to vacate the suit property and
hand over the vacant peaceful possession to the plaintiff as
prayed for? OPP
2. Whether the plaintiff is entitled to decree of permanent
injunction restraining the defendants from selling, transferring,
letting, alienating or creating any third party interest in the suit
property as prayed for? OPP
3. Whether the suit property is a shared household of the
defendant no. 2 and that she has a right to reside in the same ?
OPD-2.
4. Relief.
No other issue arises or is pressed for.
List the matter for filing of affidavit of admission/denial of
documents, and for PE on 25.09.2025.
List of witnesses be filed by both the parties within 15 days
from today. Copies of affidavit of witnesses to be examined by plaintiff
be supplied in advance to Ld. Counsel for defendant.
