This is an application for modification/correction in the judgment
dated 19.11.2025.
Present : Applicant with Sh. Ashok Kumar Singh, Ld. counsel.
Heard. Perused.
It is stated in the application that there are some typographical error
in para No. 4, 11, 12 and 17. Apart from typographical error, in the paras as stated
the applicant also wants to add the amount of EE of 7,71,121/- payable from EPFO.
Perusal of record shows that inadvertenly Sh. Sanjay Kumar (son)
and Smt. Satyawati Sinha (sister) has been written instead of Sh. Sanjay Kumar
(brother) and Ms. Satyawati Sinha (sister), name of Smt. Renu Bala Sinha instead
of Ms. Renu Bala Sinha, and name of Smt. Satyawati Sinha instead of Ms.
Satyawati Sinha in the judgment dated 19.11.2025. Same are rectified to this effect.
Further perusal of record shows that during testimony of
RW-5/EPFO the amount payable was mentioned as Rs. 1,84,074/-. However, Ld.
counsel for petitioner has submitted that as per reply filed on behalf of EPFO the
total amount payable towards the deceased as on 29.12.2023 was EE 7,71,121/- and
ER 1,84,074/- and inadvertently EE 7,71,121/- was not mentioned in the testimony
of RW-5/EPFO.
In view of the same, EPFO was summoned and Sh. Atul, SSA,
EPFO was examined as RW-7. He filed summary details, KYC detail and member
ledger of Renu Sinha having PF Account No. DLCPM00272980000000032 which
are Ex. PW7/1, Ex. RW-7/2 and Ex. RW7/3 respectively. As per member ledger
details EE Share is Rs. 9,03,604/- and ER Share is Rs. 2,15,699/- which is due and
payable to the deceased Renu Sinha as on 29.04.2026. Same is rectified to this
effect.
This order shall form part and parcel of the judgment dated
19.11.2025.
Application stands disposed of accordingly.
File be consigned to Record Room after due compliance.
