Counsel has filed on record copies of 03 authorities he wishes to rely upon. Them being of Coordinate Bench are not strictly binding. Be that as it may, clarifications offered by Ld. Counsel for the plaintiff for the time being are found to be in order as to the aspect of jurisdiction in terms of Section 13 Societies Registration Act. This is so since Section 13 prima facie operates in a sphere where any dispute arises among the governing body and Society members with regards adjustment of Society affairs at the time of its dissolution, which is strictly not what has been sought by way of relief vide the present suit. Jurisdictional question in the above regard going forward, if required and raised, may be framed later as an issue at the appropriate time and is left open. Heard. Record perused. Let summons be issued to the defendants on filing of PF / RC / through all prescribed modes returnable for NDOH. At request, dasti summons be handed over. Re-list on 30.01.2026.
