Present: Ms. Surbhi Chandra, Ld. Counsel for plaintiff.
The present suit has been filed u/o 37 CPC. Ld. Counsel for plaintiff relies
upon the promissory note, whereby the defendant had promised to pay Rs. 69,000/- with
interest on demand. It is the case of plaintiff that the defendant had made certain part
payments by way of installments as mentioned at page no. 39. accordingly this court
deems it fit to convert the present suit into ordinary suit for recovery.
Heard. Record perused.
Issue summons to the defendants by ordinary process as well as through
Post/Speed post/registered courier on filing of PF within ten days, returnable on
09.12.2026 for settlement of issues.
Summons be also issued through all permissible electronic modes.
Plaintiff is directed to file affidavit with regard to mobile no. and email
address of the defendant along with certificate u/s 65 B of Indian Evidence Act.
The process server is directed to file a report of three mandatory visits and
the summons served by way of affixation in case of non-availability/refusal of
defendants.
