Present: Ms. Nidhi Dubey, Ld. Counsel for plaintiff.
Ld. Counsel for plaintiff has filed an application under
order 7 rule 10 CPC stating that inadvertently the matter has been filed
at North District, however, jurisdiction of Central District, New Delhi is
made out as the cause of action arose at Gole Market, New Delhi.
Heard. Record perused.
Perusal of record reveals that the present suit was filed on
02.12.2025 by the plaintiff namely Kamakya Pati Tripathi (father of
master Nikunj Pati Tripathi) seeking recovery of Rs. 35,000/-. However,
in view of the facts mentioned in the application that the cause of action
arose at Gole Market, New Delhi which is beyond the territorial
jurisdiction of this court, the application stands allowed.
Let the plaint be returned to the plaintiff for the purpose of
filing it before the court having appropriate jurisdiction as per rules.
The Ahlmad is directed to do the needful.
File be consigned to record room after due compliance.
