Last and final opportunity is granted to the plaintiff to file
reply to the application u/o I Rule 10 CPC failing which the application
shall be decided on the basis of material available on record.
Vide separate statement of defendant no. 2, 3, 4, 5 & 6,
they have undertaken that they shall not create third party interest in the
suit property bearing no. S-73, Mini Market DDA, Sanjay Gandhi
Market, Mangolpuri Delhi and they shall not interfere in the suit
property as they have no concern with the suit property. Accordingly,
vide separate statement of plaintiff, the plaintiff has stated that in view of
statement of defendant no. 2, 3, 4, 5 & 6, the grievance of the plaintiff
against the said defendants stand resolved and accordingly, he wishes to
drop defendant no. 2, 3, 4, 5 & 6.
In view of the statement of defendant no. 2, 3, 4, 5 & 6 and
the plaintiff, defendant no. 2, 3, 4, 5 & 6 are dropped from array of
parties. Defendant no. 2, 3, 4, 5 & 6 shall remain bound by their
statement.
Let the amended memo of parties be filed on or before the
NDOH.
Put up for arguments/adjudication on abovesaid
application on 07.10.2024.
