An application u/s 8(1) r/w Section 8(2) of the Arbitration and
Conciliation Act filed on behalf of defendant. Copy supplied. Same is taken
on record.
Ld. counsel for plaintiff submits that interim order may be
passed to maintain the status quo with regard to the machinery, shuttering
material, construction equipment, electrical tools, scafolding, construction
material and other valuable articles at the construction site i.e. Plot No. 84,
Sector-24, Rohini, Delhi-110085. Further, not to alienate or create any third
party interest with regard to the aforesaid property till the pendency of the
suit as this may cause irreparable loss and damage to the plaintiff as the
company of the plaintiff has already carried out 70% of the construction
work and the substantial amount of payment is yet to be paid by the
defendant.
Submissions heard. Record perused.
Considering the submission of the Ld. counsel for plaintiff and
in order to preserve the suit property, the defendant is hereby directed to
maintain the status quo with regard to the machinery, shuttering material,
construction equipment, electrical tools, scafolding, construction material
and other valuable articles at the construction site i.e. Plot No. 84, Sector-24,
Rohini, Delhi-110085. Further, not to alienate or create any third party
interest with regard to the aforesaid property till next date of hearing.
