The Nazir has reported that the rent has been deposited in the present
matter.
Heard.
Without going into the merits of the quantum of rent, the present
application is allowed without prejudice to the rights and contentions of both the parties
that they may take before the court of competent jurisdiction to proceed with the DR
petition against due tenant.
Applicant/landlord is at liberty to withdraw the rent against due
acknowledgment without any prejudice to his rights by the withdrawal of rent. The
withdrawal of rent shall not have any affect upon his rights and would not be deemed as
the waiver of his rights. Accordingly, the present petition stands disposed off.
File be consigned to Record Room after due compliance.
