Order Details: COPY OF JUDICIAL PROCEEDINGS Pdf Text: CS SCJ1054/25 LALITA Vs. KISHAN AND ORS 04.09.2025 Fresh suit received from filing counter. It be checked and registered. Present: Mr. Abhishek Chand, Ld. Counsel for the plaintiff. Ld. counsel has filed copy of notification dated 22.09.2014 issued by the Revenue Department alongwith an annexure in which prescribed circle rates have been mentioned. Taking such rates into account, Ld. counsel has calculated the value of the suit property as on date today and paid court fee accordingly. A rough calculation chit is also attached alongwith the copy of the notification. All taken on record. In the suit valuation paragraph no 13 however, valuation for the purposes of jurisdiction and court fee are not cited separately, and in fact, stated to be the same. It is not proper as for the former, value of the entire suit property is required to be taken and for the latter, the share value of the plaintiff is to be considered. Certain clarifications required. Further, the rates themselves put forth by the plaintiff for calculation as aforesaid are required to be checked since the plaintiff has relied upon notification pertaining to a year 2014, i.e. more than 10 years ago.
