Steps have not been taken for service of defendant no.3 to
defendant no.6.
At request, issue fresh summons for settlement of issue to
the defendant no.3 to 6 on filing of PF within seven days, returnable for
NDOH.
An application under Order 47 Rule 1 CPC r/w Sec. 114
CPC r/w Sec. 151 CPC has been filed on behalf of defendants no.1 & 2
for setting aside the order dated 20.08.2024 along with an application
under Order 8 Rule 1 CPC r/w Sec. 151 CPC for condonation of delay
in filing of the WS. Written Statements have also been filed on behalf
of defendants no.1 & 2 along with reply to the application under Order
39 Rule 1 & 2 CPC. Advance copy was already supplied to the Ld.
counsel for the plaintiff.
Be put up for reply/ arguments on the aforesaid application
on 10.03.2025.
