Present : Ms. Mahima, Ld. counsel for the plaintiff with plaintiff.
On the LDOH, summons issued to the defendant no. 1 and
3 were received back as served upon wife of defendant no. 1 and
mother of defendant no. 3 and upon defendant no. 2 herself.
Therefore, all the defendants were duly served on
30.08.2024 as per the report on summons.
At this stage, a perusal of the record shows that defendant
no. 3 is only about 02 years old as per the memo of parties. The court
fails to understand as to why the said defendant has been impleaded as
a party in the present matter.
Ld. counsel for plaintiff submits that defendant no. 3 be
deleted from the array of parties. Acknowledgment of the same is taken
on this ordersheet itself.
Let amended memo of parties be filed by NDOH.
More than 30 days are elapsed since the date of the service
of defendant no. 1 no. 2. However neither the defendant no. 1 and 2
have appeared nor WS has been filed. Accordingly, right to file WS of
the defendant no. 1 and 2 stands closed. They are proceeded exparte.
Be put up for exparte PE on 24.05.2025.
