Present : Ms. Mahima, Ld. counsel for the plaintiff with plaintiff.
On the LDOH, summons issued to the defendant no. 1 and
3 were received back as served upon the mother of defendant no. 3,
wife of defendant no. 1.
Summons issued to defendant no. 2/Nazia received back
with the report that the name of the defendant is Razia and not Nazia.
Plaintiff is directed to clarify on the said point on the NDOH.
Qua defendant no. 1 and 3, they are deemed to be duly
served on 13.08.2024 as per the report on summons.
At this stage, a perusal of the record shows that defendant
no. 3 is only about 01 year old as per the memo of parties. The court
fails to understand as to why the said defendant has been impleaded as
a party in the present matter.
Ld. counsel for plaintiff submits that defendant no. 3 be
deleted from the array of parties. Acknowledgment of the same is taken
on this ordersheet itself.
Let amended memo of parties be filed by NDOH.
More than 30 days are elapsed since the date of the service
of defendant no. 1. However neither the defendant no. 1 has appeared
nor WS has been filed. Accordingly, right to file WS of the defendant
no. 1 stands closed. He is proceeded exparte.
Be put up for further proceedings on 24.05.2025.
