An application U/s 379 BNS r/w Sections 3 & 4 of
Oaths Act and Sections 227, 228 & 229 BNS filed for initiation
of criminal proceedings against the plaintiff. Such proceedings
are required to be undertaken independently by filing them
separately. Ld. Counsel for the defendant no. 1 undertakes to do
the needful. Considering the same, no orders are required to be
passed in this regard.
Further, in terms of statement recorded on
24.10.2024, duplicate key of the lift in question was required to
be handed over by defendant no. 1. The same has not been done.
Instead, Ld. Counsel states that the plaintiff may take the original
and make a duplicate key himself, to which the plaintiff is
agreeable. Let the needful be done within two days from today
failing which defendant no. 1 shall be held in contempt.
Also, proceedings before the Ld. ATMCD are stated
to be next listed for 20.04.2026 as defendant property booking

has already been made. Ld. Counsel for the defendant no. 1
however seeks ignorance qua the same and requests for time to
obtain instructions. Heard. Allowed. Final opportunity granted.
Both the sides to personally remain present on
NDOH together with their respective counsels.
