Taken on record. It is submitted by Ld. Counsel for plaintiff that during the visit of the concerned person from the lift agency, the defendant no.1 was present with the keys and it was found that certain repairs are needed in the lift for which next date was fixed as 14.09.2024 but defendant no.1 did not come with the keys of the lift on that day. It is further submitted that the plaintiff has received the copy of the license of the lift. On the other hand, counsel for defendant no.1 has submitted that defendant no.1 was not apprised with the next date or the further proceedings that had to be undertaken. In view thereof, Ms. Shefali Gandhi (Enroll. No.D- 3365/2020, Mobile No.9958580157) is appointed as Local Commissioner with direction to visit the property bearing no. 242, B Block, Saraswati Vihar, Pitampura, Delhi-110034 on 28.09.2024 at 2 p.m. Both the parties/their representatives shall remain present on the said date and time and the defendant no.1 Contd....P/2 -- 1 of 2 -- - 2 - shall provide the keys of the lift. The plaintiff shall also call the concerned official from lift agency on the said date and time for the inspection of the lift regarding its safety and operation. In case any further date is required to be fixed for the repair of the lift, the same shall be fixed by the Local Commissioner with the consent of the parties and the necessary cooperation shall be extended by both the parties for the same. The fees of Local Commissioner is fixed at Rs.15,000/- which shall be payable by the plaintiff. Local Commissioner is directed to file the report on the next date of hearing.
