SATISH KATARIA
Vs.
VIJAY PAL SINGH @ KANWAR VIJAY PAL SINGH
06.06.2026
Present: Plaintiff in person alongwith Ld. Counsel.
Son and daughter in law of the defendant in person
alongwith Ld. Counsel Mr. Jitendra Kumar.
Ms. Vasu Singh, Ld. Counsel for the defendant /
MCD through VC.
In terms of previous order, it is stated by Ld.
Counsel for the plaintiff that the conduct of defendant no. 1 / his
son and daughter in law has not been entirely congenial and the
lift work required to be undertaken could only be done after
much hassle. Going forward as well, it is stated that in the near
future, such work will have to be undertaken at relatively shorter
intervals since the lift operations had not been looked after
properly since years together and in that regard, cooperation of
the defendant no. 1 is sought.
Ld. Counsel for the defendant no. 1 refutes the
claims of Ld. Counsel for the plaintiff and instead states that all
necessary cooperation was extended. Even going ahead, it is
claimed that the defendant no. 1 is ready to comply with the
directions contained in order dated 11.05.2026.
Considering the overall circumstances, the Court is
of the view that for now, some more time as a cooling period as it
were is required to be granted so as to properly come to a view
with regards the parties having come at a common understanding

qua the lift related work. In view of the same, directions
contained in order dated 11.05.2026 to be complied with, as and
when required for the lift work till NDOH. Both the sides to act
in an indulgent manner.
Before concluding however, the Court must add that
the conduct of the daughter in law of defendant no. 1 present in
Court today has been anything but rather interruptive. The Court
can imagine that if state of things is as such during proceedings
here, what must be transpiring while dealing with the plaintiff.
The Court’s displeasure is conveyed to the Ld. Counsel for the
defendant no. 1 and he has undertaken to ensure that course
correction is done.
Re-list on 15.09.2026.
