Present: Ld. Counsel for the plaintiff.
In terms of previous order, application under O 6 R 17
CPC filed alongwith application under O 7 R 14 CPC for taking on
record additional documents.
Applications perused for the reasons stated therein and
for the fact, that suit proceedings are at initial stage and no
prejudice shall be caused by allowing the plaintiff to establish its
case holistically, they are allowed. Amended plaint taken on record.
The plaintiff, for the purposes of territorial jurisdiction
has brought the attention of the court to the exclusive jurisdiction
clause, contained in invoices issued. It is seen that such invoices
record the registered office address of the plaintiff at Pitampura,
Delhi as well. Considering the same, for the time being ,
submissions made, on the territorial jurisdiction are found to be in
order, left open to be agitated against going forward, if required by
the defendants.
For the reasons as aforesaid, let summons be issued to
the defendants on filing of PF / RC / through all prescribed modes
returnable for NDOH.
