An application u/o 8 rule 10 CPC has been filed on behalf of the plaintiff
for striking of defence of defendant no. 2. Written statement, application u/o 8 rule 1
CPC, reply to application u/o 39 Rule 1 and 2 CPC alongwith documents filed on
behalf of defendant no. 2. Copy supplied.

CPC heard.
An application u/o 8 Rule 1 CPC has been filed on behalf of defendant
no. 1 for seeking condonation of delay in filing of the WS. The hard copy of the WS
has been filed today. Copy of the plaint alongwith documents were supplied to the
defendant no. 2 on 09.10.2024. There is a delay of about 84 days in filing of written
statement from the date of supply of copies. In the application for seeking
condonation of delay, it is stated that there was delay as the defendant no. 2 was also
contesting against defendant no. 1 in another matter pending between the parties.
The delay is condoned subject to cost of Rs. 3,000/- to be paid to the
plaintiff by the defendant no. 2. Both the application u/o 8 rule 1 CPC and
application u/o 8 rule 10 CPC are accordingly disposed of.
