An application under Order 6 Rule 17 CPC seeking amendment in
the plaint and another application under Section 152/153 CPC for correction in
order dated 02.09.2025 filed on behalf of the plaintiff is pending adjudication. It is
stated in the application that in the prayer clause of the original plaint Khasra no.
20/1 (3-14) was wrongly mentioned as 20/13-14 and consequently in order dated
02.09.2025 also the Khasra number was wrongly mentioned as 20/13-14 instead of
20/1 (3-14). It is further stated in the application that Khasra No. 37/16/2/1 (1-8) is
also wrongly mentioned as 27/16/21 (1-8) in Para no. 3 and 14 of the plaint due to
typographical error.
Hence, it is prayed that above stated error may be rectified. Ld.
counsel for defendant has no objections, if abovestated applications are alllowed.
In view of the non-objection and for the reason stated in the
applications, both the applications stand allowed. Amended plaint be taken on
record.
Further, it is clarified/rectified that in order dated 02.09.2025 the
correct Khasra No. is 20/1 (3-14) instead of 20/13-14.
Both applications stand disposed off, accordingly.
Ld. counsel for plaintiff has submitted that for the purpose of
evidence of the plaintiff other official witnesses also needs to be summoned for the
next date of hearing.
Submissions heard. Allowed.
Let official witnesses mentioned in the list of witnesses be
summoned for the next date of hearing on filing of PF.
Be put up for PE on 06.08.2026.
