Present: Sh. S.P Bansal, Ld. counsel for plaintiff with
plaintiff.
Ms. Bhavya, Ld. counsel for defendant with defendant
(defendant was proceeded ex-parte on 01.09.2026).
An application u/O 9 Rule 7 CPC has been filed on
behalf of defendant for setting aside ex-parte order dated 01.09.2026.
Copy supplied.
Ld. counsel for defendant submits that the defendant had
engaged a lawyer to appear on her behalf but that the said lawyer did
not appear. It is further stated that the non appearance of defendant
was unintentional and not deliberate.
Ld. Counsel for the plaintiff submits that he has no
objection, if the application is allowed, subject to cost.
In the interest of justice, the application is allowed and
the ex-parte order dated 01.09.2026 is set aside, subject to cost of
Rs.1000/- to be paid to the plaintiff on the NDOH.
Let WS be filed by the defendant within 30 days from
today with advance copy to the plaintiff.
At this stage, both the parties inform that possibility of
settlement may be explored and matter may be referred for mediation.
Considering the same, both the parties are hereby referred for
mediation proceedings for 31.10.2026 at 02:00 PM at the Mediation
Centre, Rohini Courts.
Re-list for further proceedings on 28.01.2027.
