On perusal of the case file, it is observed that the
matter is at the stage of filing of reply to the application u/o 6
rule 17 CPC. Time sought by Ld. Counsel for the defendant.
Heard. Allowed. Final opportunity given. Ld. Counsel for the
plaintiff to also address the court on the aspect of valuation of the
amended relief of declaration of title.
It is also seen that an application u/o 39 rule 1 and 2
CPC is pending disposal. In the said application, it is prayed that
the defendant be restrained from sub letting/assigning/parting
with possession/creating third party interest in the suit property
(C-8/40, 3rd floor, Lawrence Road, Keshav Puram, Delhi-35) till
the pendency of the suit proceedings.
Ld. Counsel for the defendant as well as the
defendant herself state that they have no intention of sub
letting/assigning/parting with possession/creating third party
interest in the suit property (C-8/40, 3rd floor, Lawrence Road,
Keshav Puram, Delhi-35) till the pendency of the suit
proceedings.
Accordingly, defendant is hereby restrained from
sub letting/assigning/parting with possession/creating third party
interest in the suit property (C-8/40, 3rd floor, Lawrence Road,

proceedings.
Application u/o 39 rule 1 and 2 is disposed in the
abovementioned terms.
