Ld. Counsel informs that certified copy of site plan
has already been filed and compliance has been made with order
dated 12.07.2025. Submissions found to be in order.
Case file perused.
The original suit was one,
inter alia, for mandatory
and permanent injunction, effectively seeking handing over
vacant and peaceful possession of suit property.
In view of the above, JDs are directed to handover
peaceful possession of the suit property to the DH forthwith
without delay in compliance of the decree dated 21.04.2025.
Further, since Order 21 Rule 32 CPC is applicable to the present
execution proceedings, the decree in question being one for
injunction, instead of warrants of possession, warrants of
attachment are liable to be issued.
Accordingly, let warrants of attachment of movable
properties of the JDs be issued on filing of PF returnable for
NDOH.
DH is directed to appear before the office of Ld.
ACJ for appointment of Bailiff on 10.03.2026 at 02:00 PM.
Re-list before this Court on 24.04.2026.
