no. 1 / DJB in person alongwith Ld. Counsel Mr. Vipin

An application seeking to file fresh address of
defendants no. 2 & 3 already stands filed. Taken on record. Addresses
of defendants no. 2 & 3 are common. As such therefore, let fresh
summons be issued to both the defendants no. 2 & 3 on filing of PF /
RC / through all prescribed modes returnable for NDOH.
WS filed on behalf of the defendant no. 1 / DJB. Taken
on record. Copy supplied.
Upon Court query, the official from DJB informs that no
notice has been issued to the plaintiff till date with regards
disconnection / removal / un-installation of sewerage connection. It is
stated instead that the area in question has recently been included in
the jurisdictional division and proceedings, if required, shall be
undertaken going forward. If that be so, defendant no. 1 is restrained
from undertaking disconnection / removal / un-installation of
sewerage connection available in the suit property till further
directions / without Court permission. The order be treated as one
under O 39 R 1 and 2 CPC.
Let replication, if any, be filed with an advance copy to
the defendants at least a week prior to NDOH.
Re-list on 07.04.2026.
