Written Statement was filed on behalf of defendant on
20.03.2025 whereas the defendant was served on 13.01.2025. Fresh
vakalatnama and list of documents alongwith the documents have also
been annexed alongwith the Written Statement.
Even though the Written Statement has been filed beyond
the prescribed period of time, no application for condonation of delay
in filing of Written Statement has been moved on behalf of defendant.
However, in the interest of justice, the delay is condoned and the
Written Statement is taken on record subject to cost of Rs. 1,000/- to be
paid to the plaintiff on the next date of hearing.
Replication has been filed by the plaintiff. Additional copy
has been placed on record. Defendant is at liberty to take the same from
record as and when he appears before this court.
