Sh. Vijay Yadav, Ld. Counsel for JD with JD.
Ld. Counsel for DH has submitted that he had received a sum of
Rs. 2 lakhs in cash out of Court. Today, he had also received a post dated cheque
dated 10.04.2026 from JD in the name of DH for a sum of Rs. 2,50,000/-. He has
further submitted that he has been assured that on presentation of cheque dated
10.04.2026, the same shall be honoured and encashed.
Ld. Counsel for DH has submitted that DH may be permitted to file
criminal proceedings against JD if the same gets dishonoured in addition to
getting the present execution petition revived from this stage itself and he
requests to dispose off present execution petition as satisfied.
Separate statements of Ld. Counsel for DH and JD are recorded in
this regard.
In view of statements of Ld. Counsel for DH and JD, the present
execution petition is disposed of as withdrawn being satisfied and the warrants of
attachment issued against JD on the last date of hearing stands cancelled.
Copy of order be put up before In-charge Nazarat Branch for doing
needful.
File be consigned to Record Room after due compliance.
