on behalf of plaintiff no. 1 for violation of the interim injunction
granted vide order dated 11.05.2026 is pending adjudication.
Ld. Counsel for the defendant no. 5/DDA submits
that copy of documents have not been supplied to DDA.
However, a perusal of the ordersheet dated 11.05.2026 shows that
copy of the documents were supplied to the same counsel who is
appearing today on behalf of defendant no. 5/DDA today.
Ld. counsel for defendant no. 5/DDA seeks an
opportunity to file WS with an application for condonation of
delay.
An application under Order 7 Rule 11 CPC filed on
behalf of defendant no. 1 to 4 is pending adjudication.
Let reply to the afore-mentioned application be filed
by the plaintiff with advance copy to the opposite side.
Reply to the application under Order 39 Rule 2A
CPC filed on behalf of defendant no. 1 to 4. Copy supplied.

Ld. counsel for MCD submits that copy of the
pendrive alongwith application u/s 39 Rule 2A CPC has not been
received by MCD. Let the same be supplied by the plaintiff
within two weeks from today.
Let fresh inspection be conducted by the MCD on
the premises in question and file report to this effect on the next
date of hearing.
Be put up for reply/arguments on the application
under Order 39 Rule 2A CPC and on the application under Order
7 Rule 11 CPC on 27.10.2026.
Pre-fixed date of hearing i.e. 18.09.2026 stands
cancelled.
