SONU AND ORS Vs. MCD AND ORS
01.07.2025
Present : Mr. Virender Sangwan, Ld. Counsel for plaintiff.
It is seen that the matter is at the stage of
consideration. On perusal of the case file, it is observed that no
site plan has been filed. The present matter is one for injunction
for restraining the defendants from carrying out
illegal/unauthorised construction. Averments in that regard
however have been made in general terms only. The photographs
filed too do not give a clear picture. As such therefore, site plan is
required so as to properly gauge the situational details of the
plaintiffs' houses viz a viz those of the defendants' so as to
understand the nature of personal grievance of the plaintiffs.
Ld. Counsel seeks some time for filing of site plan.
Heard. Allowed.
Re-list for 03.09.2025.
At this stage, Ld. Counsel states that the court may
pass orders and he shall pursue his remedy before the Ld.
Appellate Court since the date given is of September. The date
given is according to the board of the court. Moreover, the
manner in which Ld. Counsel has off the hand stated about
approaching the Ld. Appellate Court, the tone and tenor of it, is
not understandable as he has neither requested for any shorter
date nor specified any other date of his liking. Without doing any
of it, he has suddenly thrown up his hands as it were by stating
that he shall approach the Ld. Appellate Court. The court is
befuddled by such conduct. Be that as it may, whatever the
inclinations be, plaintiff/Ld. Counsel is at liberty to approach any

forum of his liking as per law.
For the time being, as to the proceedings of this
court, let compliance be made and site plan be filed by NDOH.
Re-list on date already given.
