The suit in question is between husband and his
wife. If that be so, maintainability of the suit before this Court is
required to be explained. Further, the relief sought is one for
cancellation of a gift deed executed in 2021. The stamp duty paid
at that time took into account consideration of approximately Rs.
13.15 Lakhs. Considering the same, valuation for the purposes of
Court fees and jurisdiction now taken in a suit filed in 2025
appears to be improper. Clarification required. Time sought.
Heard. Allowed.
