Present: Mr. Ishan Bery, Ld. Counsel for the plaintiff through
VC.
On perusal of the case file, it is observed that
defendant no 2 has not been served. Even defendant no. 1 has
been served by way of email only.
In view of the above, it shall be in fitness of things to
serve upon both the defendants through affixation to confirm the
veracity of the address provided.
Accordingly, let defendants be served by way of
affixation on filing of PF returnable for NDOH. Copies of
photographs be attached with the summons report to be furnished.
Further, Ld. Counsel further informs that an
application under O 5 R 20 CPC has already been filed qua
service upon defendant no. 2. Heard. For the reasons stated
therein, it is allowed as well as efforts in usual course have not
yielded positive results for serving upon the defendant no. 2.
Let the defendant no. 2 be served by way of
publication to be made in the local newspapers in circulation in
the area where the defendant no. 2 is stated to have last resided.
Publication charges be accordingly deposited. Copy of publication
be filed on NDOH.
Re-list on 11.11.2025.
