Written statement filed on behalf of non applicant alongwith spare
copy for the opposite party. Same be taken on record.
Ld. counsel for non applicant has submitted that the present
application under Section 45 DRC Act is not maintainable as per the admission
of applicant himself the rate of rent qua suit property is Rs. 6,000/- per month.
Further, he has submitted that in appeal due to inadvertence the rate of rent was
fixed to be Rs. 3,000/- per month and he has preferred revision against the order
in appeal dated 21.08.2025 which is pending in the month of August 2026.
Considering the submissions of Ld. counsel for non applicant,
since it is not clear as to whether the provisions of DRC Act applies to the
property in question, this Court is not passing any order at this stage.
Be put up for clarification and further proceedings on 03.09.2026.
