17 CPC has been filed together with deficient Court fee.
Reader has reported the overall Court fee to be now
in order.
Further, vide the application under O 6 R 17 CPC,
the inadvertent error of stating the defendant firm as
proprietorship in paragraph no. 5 of the plaint is sought to be
amended. The amendment is seen to be formal in nature. As such
therefore, the application is allowed. Amended plaint taken on
record.
With respect to the cause of action and the period of
limitation, Ld. Counsel has relied upon judgment of the Hon’ble
Supreme Court as stated in paragraph no. 21 of the amended
plaint. For the time being, the same is seen to be satisfactory.
In view of the above, let summons be issued to all
the defendants on filing of PF / RC / through all prescribed
modes returnable for NDOH.
