Present : Sh. Vikesh Kumar, Ld. counsel for plaintiff through VC.
Sh. Raman, Accountant of defendant company, is present
through VC to represent both the defendants.
The defendants were served on 22.04.2025 through
defendant no. 2 himself.
It is submitted by official appearing on behalf of defendant
company that they have not received copy of the plaint whereas the
receiving of defendant no. 2 on the report on summons itself states that
he has received 26 pages. After informing the same to the official, he
now states that the copy received is not legible, it then appears that the
defendants are only trying to delay the present matter. If the copy
supplied was unclear, they were at liberty to move an application before
the court for supplying the clear copy as they were served way back in
April, 2025. Till date, no such application has been filed and it is clear
that the intent of the defendants is only to delay the present matter.
Therefore, as more than 30 days have elapsed since the
date of the service but Written Statement has not been filed on behalf of
defendants, the right of the defendants to file Written Statement stands
closed.
