Present : Ms. Parul Rahotgi, Ld. Counsel for plaintiff through
VC.
Summons issued to defendant no.1, 2 and 4 received
back unserved as no such person i.e. defendants reside there at that
address. Same could be served only by way of affixation on
31.03.2026.
Defendant no.3 was served on 31.03.2026. No WS has
been filed on behalf of defendant no.3 yet.
Defendant no.3 is at liberty to file WS as per rules.
The plaintiff is directed to file fresh and correct address
of the defendant no.1, 2 and 4 and email IDs of the defendant no.1, 2
and 4 on affidavit along with PF/speed post cover for service to the
defendant no.1, 2 and 4 for the next date of hearing.
Plaintiff is directed to collect dasti copy of additional
summons to be served to defendant by hand as per rules and to file the
report of service on affidavit as per rules on NDOH.
Process Server is directed to give report of three
mandatory visits and in case of non-availability/refusal summon be
served by way of affixation.
Further, Plaintiff to submit the internet generated
tracking report of proof of delivery of summons sent through post
alongwith the certificate of Section 63 of the BSA on the next date of
hearing.
