None for other defendants.
Ld. Counsel for defendant no.3 has submitted that
defendant no.3 has not received the copy of documents alongwith
summons.
The perusal of record shows that defendant no.3 was
served on 31.03.2026. More than 6 months have already passed
from the date of service. It is surprising to note that defendant
no.3 has not informed about the same to Court or to Ld. Counsel
for plaintiff. Further, defendant no.3 has not appeared on last date
of hearing and apprised the Court about the same.
Though, it cannot be believed that submissions
regarding non receiving of copy by defendant no.3 is correct,
however, in the interest of justice, subject to cost of Rs.2,000/- to
be paid by defendant no.3 to plaintiff, plaintiff is directed to
supply one set of documents annexed with plaint to Ld. Counsel
for defendant no.3.
Ld. Counsel for defendant no.3 has undertaken that
he will mention his email id in the chatbox after proceeding of
this case will be over.
Defendant no.3 will be at liberty to file WS within

20 days from the date of receiving of documents with advance
copy of the same to the opposite side at least 15 days before next
date of hearing against proper acknowledgment. Plaintiff shall
file replication, if any on the next date of hearing.
Plaintiff has not taken any steps in compliance of
order dt. 10.06.2026 for service to defendant no.1, 2 and 4. In the
interest of justice, subject to cost of Rs.1,500/- to be deposited by
the plaintiff in the RCBA, last and final opportunity is being
given to the plaintiff to comply order dt. 10.06.2026 qua service
to defendant no.1, 2 and 4.
