HC Sharad Yadav in person.
In terms of previous order, Ld. Counsel for the plaintiff
states that defendant no. 1 was totally uncooperative and some work
of cementing, which had to be undertaken, was paid off by the
plaintiff himself (Rs. 2,000/-).
HC Sharad Yadav present in Court has filed compliance
report as well alongwith copies of photographs. Taken on record.
Ld. Counsel for the plaintiff in fact states that despite the
work undertaken, the seepage issue has not been resolved in totality.
Ld. Counsel for the defendant no. 1 present denies the
claims of the plaintiff in entirety.
In view of the above, it shall be in fitness of things to
commence evidence recording with issues having already been framed
and no common understanding having been reached between the
parties. Ld. Counsel for the plaintiff to file an application, if required,
for recovery of the amount expended in the exercise undertaken in
terms of Court directions on LDOH.
Parties are directed to file list of witnesses within 15
days from today. Plaintiff is directed to file affidavit in evidence and
supply advance copy of the same to the defendants at least a week
prior to NDOH.
Re-list for PE on 04.06.2026.
