Present: Plaintiff in person alongwith Ld. Counsel.
Defendant in person alongwith Ld. Counsel.
In terms of previous order, compliance could not be
made since as per Ld. Counsel for the plaintiff, the defendant did
not cooperate. No cogent reason is given for such non compliance.
In view of the above, let police aid be provided to the
plaintiff from PS North Rohini for ensuring compliance of order
dated 16.10.2025. The police is at liberty to use as much force as
is necessary, which is legally permissible, to prevent non
compliance of Court order in case of any obstruction from the
defendant end. The plaintiff to take their plumber for inspection of
the suit property. The entire exercise be carried on 14.01.2026,
subject to availability of police assistance. In case such availability
is not there for the date fixed, they may provide such aid for any
other convenient date, before NDOH. Irrespective, all parties
including the police authorities to ensure that order dated
16.10.2025 is complied with. Let Court notice be issued to SHO
PS North Rohini in this regard returnable for NDOH and copy of
order dated 16.10.2025 be also annexed with the same.
Re-list on 02.04.2026.
Copy of this order be given dasti.
