Defendant no. 1 in person alongwith Ld. Proxy Counsel. Parties submit that there are no documents inter se the parties for the purpose of admission / denial. Pleadings are complete. The following issues emerge from the pleadings: Issue no. 1: Whether the plaintiff is entitled to a decree of permanent injunction thereby restraining the defendants from causing damage in the plaintiff premises towards adjacent wall of his house? OPP. Issue no. 2: Whether the plaintiff is entitled to a decree of mandatory injunction directing the defendants to repair the damaged wall of the plaintiff house and filling the jhirris on such wall? OPP. Issue no. 3: Whether the plaintiff is entitled to a decree of damages of Rs. 2 Lakhs? OPP. Issue no. 4: Relief. No other issue is made out or pressed upon. Parties are directed to file list of witnesses within 15 days from today. Plaintiff is directed to file affidavit in evidence and supply advance copy of the same to the defendants at least a week prior to NDOH. Due to Court intervention, the defendant no. 1 present has agreed to take his plumber to the house of the -1/2- -- 1 of 2 -- plaintiff on a mutually convenient date in the week 27.10.2025 to 01.11.2025, preferably in the presence of counsels on either side and the plaintiff himself, to get inspected the plaintiff area and his grievance in that regard, with an intention to amicably address the problem. Both the sides to maintain proper conduct and ensure resolution in a peaceful manner. Re-list for PE on 08.01.2026.
