Present: Ld. Counsel for the plaintiff.
Defendant in person alongwith Ld. Counsel.
An application has been filed on behalf of the
defendant for recall of order dated 11.08.2025 vide which right of
the defendant to cross examine PW3 was closed. It is stated in the
application that Ld. Counsel for the defendant could not appear on
the said date as he was suffering from viral fever. No such ground
was taken by Mr. Naveen appearing on behalf of the Ld. Main
Counsel on the said date. In fact, it is also seen that previously as
well, due to the irregular conduct of the defendant, cost of Rs.
1,000/- was imposed upon her on 18.10.2024, which remains
unpaid till date. The said order stands.
Be that as it may, since the ground taken in the
application is with regards the Ld. Counsel for the defendant
being unwell and the defendant must not be penalized for the
same, application is liable to be allowed. Having said so, since the
defendant has been not proceeding diligently as reflected by
order-sheet dated 18.10.2024 as well, a further cost of Rs. 1,000/-
is imposed, taking the cumulative cost of Rs. 2,000/-. The same be
paid.
Cost paid.
Re-list for cross examination on 01.12.2025.
