Sh Ankit Gupta, Ld Counsel for defendant alongwith
defendant.
Matter is at the stage of completion of pleading/arguments
on the application for condonation of delay.
Ld Counsel for the defendant submits that due to medical
reason the WS could not be filed on time. He further submits that
defendant was engaged in taking care of her sister in law as the sister in
law of the defendant had given birth to a baby and the doctor had
directed to take proper care of the sister in law.
Ld Counsel fr the plaintiff has strongly objected to the
present application and has requested to dismissed the same.
Heard. Record perused.
This Court is of the opinion that in an adversarial trial no
party should ordinarily be denied right to participate in justice delivery
system. Further the delay in filing the WS has bee sufficiently explained
by the Ld Counsel for the defendant.
In view of the above discussion, the present application for
condonation of delay in filing the WS stands allowed. The WS is taken
on record. Ld Counsel for defendant is directed to supply the copy of
WS within one week from today.
List the matter for completion of pleading/ filing the
replication on 28.05.2025.
