Sh. Digvijay Singh, Ld. Counsel for defendant alongwith
defendant.
WS, application for condonation of delay in filing of WS
alongwith reply of the application u/o 39 rule 1 & 2 CPC has been filed
on behalf of the defendant. Extra Copies retained on record to be released
to the plaintiff as and when asked for. It is to be borne in mind that
procedure is a handmaid of justice. In the interest of justice and in order
to decide the matter on merits, the application for condonation of delay in
filing of WS by defendant is hereby allowed and the WS is taken on
record.
As regards application u/O 39 Rule 1 & 2 CPC, the
plaintiff has prayed that the defendant should be restrained from creating
any third party interest in the suit property till the disposal of the suit. It
is observed that the defendant has submitted on LDOH that he shall not
dispose off the same till the disposal of the suit. Separate statement of
defendant was also recorded to that effect. In view of the same,
application u/O 39 Rule 1 & 2 CPC stands already allowed and disposed
off.
Replication, if any, be filed within 3 weeks with advance
copy to the opposite party.
Now to come up for completion of pleadings/admission-
denial of documents/framing of issues on 23.09.2023.
At 12.15 pm Sh. Manoj Rathi, Proxy counsel for plaintiff has appeared
and extra Copies retained on record is released to the plaintiff.
