Fresh suit received from filing counter. It be checked and
registered as per rules.
Present: Mr. Himanshu Sharma, Ld. Counsel for the plaintiff.
Heard. Record. Perused.
Since the suit is one for injunction only, requirement
for statutory notice is dispensed with considering the nature of
averments taken.
Let summons be issued to the defendants on filing of
PF / RC / through all prescribed modes returnable for NDOH.
Ld. Counsel has prayed for restraining orders uptil
NDOH. Such a request however is not liable to be favourably
considered since most short accommodation has been made for one
week only. Moreover, the alleged Zig Zag entry gate of the Zig Zag
park situated in front of the house of the plaintiff does not vest any
exclusive right in the plaintiff favour to prevent its opening in law.
By Ld. Counsel’s on admissions, there are 03 more such gates
elsewhere in the same park, which are open. Considering the same,
without hearing the defendants, who are all statutory bodies, this
court is not inclined to pass any ex parte orders.
Re-list on 16.02.2026.
