Present : Sh. Mirtunjaya Singh, Ld. proxy counsel for the plaintiff.
An application under Order 5 Rule 20 CPC has been filed
on behalf of the plaintiff.
Arguments heard. Record perused.
It is stated on behalf of the plaintiff that the defendant is
deliberately avoiding the service of the processes. It is further stated
that no other address of the defendant is available with them. Hence, it
is prayed that the defendant be served by way of publication.
In view of submissions and considering the facts and
circumstances, request is considered. Defendants be served by way of
substituted service i.e. by way of publication in Newspaper Veer Arjun
having local circulation of the area where defendant is residing, on
filing of PF and charges. Steps be taken within one week from today.
At this stage, it is observed that the loan in question was
taken by Sh. Ganesh and that his wife Sarsoo was the guarantor. Sh.
Ganesh as well as Smt. Sarsoo subsequently expired and the present
suit has been filed against the LR of Sh. Ganesh and Smt. Sarsoo i.e.
G. Loknath.
It is hereby clarified that only that amount can be
recovered from G. Loknath which has been inherited by him from the
estate of the deceased persons.
Be put up for further proceedings on 23.09.2025.
